Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using Lookist ("the App," "we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Medical Disclaimer

Lookist provides general wellness guidance based on self-reported goals and photo analysis. It is not medical, dermatological, or psychological advice. Do not use Lookist as a substitute for professional medical consultation. If you have concerns about your skin, facial structure, or mental health related to appearance, consult a licensed healthcare professional.

Routines tagged as "Experimental" reference compounds that are not FDA-approved and may carry significant health risks. These are included for informational transparency only and are not recommendations. Mandatory safety warnings are displayed before any experimental routine can be enabled. You assume all risk if you choose to follow any experimental routine.

3. Eligibility

You must be 13 years or older to use Lookist. By creating an account, you represent and warrant that you meet this age requirement. The App is rated 17+ on the App Store.

4. Account

You are responsible for maintaining the confidentiality of your Apple Sign-In credentials and for all activity that occurs under your account. You may delete your account at any time through the Profile tab in the App, which permanently removes all your data including photos, scores, and routines.

5. Subscriptions and Payments

Lookist Pro is available as a subscription with the following plans:

• Weekly: $9.99/week
• Annual: $39.99/year

Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

Managing subscriptions: You can manage or cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain access to Lookist Pro features until the end of the period you have already paid for.

Price changes: We may change subscription prices. Price changes will be communicated in advance and will take effect at the start of your next billing period after the change. Continued use constitutes acceptance of the new price.

6. Refund Policy

All purchases are made through Apple's App Store.

• Subscriptions: You may cancel at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing period.
• Refund requests: Refunds for App Store purchases are handled by Apple in accordance with their refund policies. To request a refund, contact Apple Support.

Due to the immediate delivery of AI-generated analysis results, we cannot offer refunds for analyses already completed.

7. Your Content

You retain ownership of the photos you upload to Lookist. By uploading photos, you grant Lookist a limited, non-exclusive license to process them solely for the purpose of generating your facial analysis and displaying results within the App. We do not use your photos for AI model training, marketing, or any purpose beyond delivering your personal analysis results.

8. Prohibited Uses

You agree not to:

• Upload photos of other people without their explicit consent
• Use the App if you are under the age of 13
• Reverse-engineer, decompile, disassemble, or attempt to extract the AI analysis model or source code
• Use the service for harassment, bullying, discrimination, or harm to others
• Automate access to the service, scrape data, or use bots
• Attempt to circumvent any security measures or access controls
• Redistribute, resell, or sublicense any part of the service

9. Intellectual Property

The Lookist name, logo, design, code, AI models, and all related intellectual property are owned by Lookist. You may not copy, modify, distribute, or create derivative works based on the App or its content without our prior written consent.

10. Termination

We may suspend or terminate your access to Lookist at any time, with or without notice, if you violate these Terms or engage in conduct that we determine is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately. You may request deletion of your data following termination by contacting [email protected].

11. Limitation of Liability

To the maximum extent permitted by applicable law, Lookist is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or that results will be accurate.

In no event shall Lookist be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages for loss of data, goodwill, or other intangible losses.

Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to Lookist in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lookist and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of Lookist shall be resolved through binding arbitration, except where prohibited by law.

14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect the most recent revision. Continued use of the App after changes constitutes acceptance. Material changes will be communicated through the App before they take effect.
